The Hosieria company is responsible for their own content pursuant to Sec 5, subsec 1 Mediendienste-Staatsvetrag (Media Service State treaty) and Sec 5 of the Teledienste-Gesetze (teleservice-laws). It is important to distinguish between the Hosieria's own content and the links to content from other distributers/manufacturers. Because of these links, the Hosieria company can supply the content from other distributers/manufacturers. Hosieria is only responsible for the foreign content if there is a positive knowledge of any criminal or illegal content and it would technically be possible to avoid the use of this content. "Links" are always dynamic references. The Hosieria examined foreign content with the first linkage whether a possible civil or criminal liability could be caused. Hosieria is however not obligated to constantly check the content for changes, which could re-justify accountability. Only if Hosieria discovers or is pointed out that a concrete offer releases a civilian or criminal pursuit , Hosieria annuls the link to this offer, as far as this is technically possible and reasonable. The technical possibility and reasonableness are not affected by the fact that also after the prevention of the annuled link, the illegal or criminal offer entity can still be accessed through the Hosieria homepage from other servers.
